SALES TERMS AND CONDITIONS GOODS AND SERVICES
Queensland Rifle Association Inc. trading as The Q-store (QRA)
1. Registration and Account
1.1 You must register your details with us to use this Service, which will create an account (“Account”).
1.2 Registration is free and does not require you to purchase anything from Queensland Rifle Association (“QRA”) or the Site.
1.3 You must not use false or misleading information when registering or using the Service and must update your details if they change. We are not responsible for any loss or damage (including misdirected deliveries or notifications) resulting from inaccurate or incomplete information.
1.4 You must choose an email address when registering your Account. You are responsible for maintaining the security of your Account and we will assume that anyone using your Account is authorised by you. Unauthorised use of your Account will not reduce your liability, including your obligation to purchase any Product ordered using your Account.
1.5 You must notify us immediately if you become aware of any unauthorised use of your Account or other security breach.
1.6 You permit us to send notifications by email regarding delivery status, invoices, and marketing or promotional offers. You may opt out of marketing communications during registration or at any time thereafter.
1.7 We accept no liability for any loss or damage incurred if you do not receive notifications from us for any reason.
2. Ordering a Product
2.1 We may offer Products for sale on the Site and you may place an Order for a Product.
2.2 By placing an Order, you warrant that:
(a) you are over 18 years of age; and
(b) you meet any conditions required by law to purchase and own the Product ordered.
2.3 The sale price of the Product will be as shown on the Site at the time you place your Order.
2.4 Unless otherwise stated, prices are exclusive of:
(a) delivery costs, which must be paid in addition to the sale price.
2.5 Orders are subject to acceptance by QRA. We reserve the right to refuse or cancel any Order at our discretion.
3. Payment Terms
3.1 Payment for goods must be made prior to shipment.
3.2 Payment will be processed and subject to approval by our accounts department.
3.3 Payment may be made by:
(a) Electronic Funds Transfer (EFT) direct to our nominated account; or
(b) Credit card facilities provided on this Site.
3.4 Appropriate clearance times will apply before goods are dispatched.
3.5 QRA reserves the right to withhold shipment until payment has cleared in full.
4. Delivery and Shipping
4.1 Orders over $1,000 excluding GST will be shipped free to major locations within Australia. Forwarding locations will be quoted separately or may use their own freight supplier.
4.2 Delivery will be made via the most economical method unless otherwise specified by the Customer.
4.3 Minimum freight charge is $20.00 (ex GST).
4.4 If delivery is attempted and the premises are closed, any additional delivery charges imposed by the courier will be passed on to the Customer.
4.5 If delivery is not possible on a certain date or time, the Customer must notify QRA prior to shipment.
4.6 All claims for incorrect, short, or transit damaged goods must be made in writing within seven (7) days of receipt.
4.7 Freight on returns for incorrect or damaged goods must be arranged using QRA’s nominated freight supplier. Returns shipped using non-approved carriers may not be accepted.
5. Returned Goods
5.1 No merchandise may be returned for credit without prior written authorisation from QRA. Contact us at enquiry@queenslandrifle.com.au
5.2 Goods returned for credit must:
(a) be shipped prepaid;
(b) include a copy of the original invoice; and
(c) be in new, saleable condition.
5.3 Returned items may attract a 20% restocking fee.
5.4 If an item was incorrectly supplied by QRA, the Customer must notify QRA within seven (7) days of receipt to avoid a restocking fee.
6. Ownership and Risk
6.1 Risk of loss or damage to the Goods remains with QRA until the Goods are made available to the Customer in accordance with the Delivery clause.
6.2 Ownership and title to the Goods passes to the Customer only upon full payment of the relevant invoice.
6.3 Until full payment has been made, QRA reserves the right to:
(a) retain ownership of the Goods;
(b) enter the Customer’s premises (or any premises where the Goods are located) without liability for trespass and retake possession of the Goods; and
(c) subject to the Personal Property Securities Act 2009 (Cth), keep or resell any repossessed Goods.
7. Licences and Approvals
7.1 Unless otherwise advised by QRA, the Customer must obtain and maintain all licences, permits, and approvals required for the lawful purchase, possession, use, import, export, or resale of the Goods.
7.2 The Customer warrants that they comply with all applicable Commonwealth, State, and Territory laws relating to the purchase and possession of the Goods.
7.3 QRA accepts no responsibility for delays or non-delivery resulting from the Customer’s failure to obtain required licences or approvals.
8. Advertising and Marketing
7.1 The following rules apply relating to the presentation of Peterson Cartridge Co (PCC) products.
7.2 Only the approved product images, supplied by PCC, may be used in digital or print advertising. This includes websites, social media platforms, catalogs, sales flyers, and any and all other forms of advertising.
7.3 Ony the approved PCC logo images, supplied by PCC, may be used in digital or print advertising. This includes websites, social media platforms, catalogs, sales flyers, and any and all other forms of advertising.
7.4 Only the approved PCC product descriptions, supplied by PCC, may be used in digital or print advertising. This includes websites, social media platforms, catalogs, sales flyers, and any and all other forms of advertising.
7.5 Only the approved PCC packaging, provided by PCC, may be used in the display and sale of PCC products. This includes plastic retail boxes, labels, bagged bulk packages, and any and all other PCC provided packaging materials.
7.6 PCC bulk packages are intended to be sold in whole to consumers wanting to buy large, single lot quantities. Breaking bulk packages and repacking them into smaller retail packages is expressly prohibited.
